Απόφαση υπ΄αρ. 1471/2018 αντιμωλία με Πολιτική Αγωγή, Τριμελές Πλημμελειοδικείο Αθηνών. Συκοφαντική δυσφήμηση η οποία φέρεται ως τελεσθείσα δια αίτησης ασφαλιστικών μέτρων με αιτούσα σύζυγο κατά του συζύγου της με αντικείμενο δίκης ζητήματα επιμέλειας, διατροφής και επικοινωνίας ανηλίκων τέκνων. Εγκαλούσα και πολιτικώς ενάγουσα έτερο πρόσωπο που αναφέρεται στην ως άνω αίτηση ασφαλιστικών μέτρων. Φερόμενη συκοφαντική δυσφήμηση και ψευδορκία μαρτύρων στην εν λόγω δίκη ασφαλιστικών μέτρων. Φερόμενη ηθική αυτουργία της συζύγου ως προς τις ανωτέρω πράξεις.
Το Δικαστήριο έκρινε αθώους όλους τους κατηγορούμενους (την σύζυγο καθώς και τους μάρτυρες αυτής που κατέθεσαν στην εν λόγω δίκη ασφαλιστικών μέτρων), διότι από τις διατάξεις των άρθρων 362 και 363 Π.Κ. προκύπτει ότι το έγκλημα της συκοφαντικής δυσφημήσεως στοιχειοθετείται όταν κάποιος ισχυρίζεται ή διαδίδει για άλλον περιστατικά του εξωτερικού κόσμου, εμπίπτοντα στις αισθήσεις και διυποκειμενικώς ελέγξιμα (δεκτικά αποδείξεως), που είναι αντικειμενικά ψευδή εν γνώσει του δράστη περί της αναλήθειας τούτων και υπό την πρόθεσή του να προβεί στην εκφορά βλαπτικής της τιμής ισχυρισμού ή διαδόσεως. Ο ισχυρισμός και η διάδοση αναγκαίως πρέπει να γίνονται ενώπιον τρίτου προσώπου. Δεν είναι όμως τρίτος κατά την έννοια του Νόμου εκείνος ο οποίος λαμβάνει γνώση ισχυρισμών εκ λόγων καθήκοντος, όπως είναι οι Δικαστικοί Λειτουργοί, οι Δικαστικοί Υπάλληλοι και οι Δικαστικοί Επιμελητές οι οποίοι έλαβαν γνώση του δικογράφου της αγωγής του εγκαλουμένου. Εξάλλου ο χαρακτήρας του εγκλήματος της συκοφαντικής δυσφήμησης ως αφηρημένης διακινδυνεύσεως, διόλου δεν σημαίνει ότι η βλάβη της τιμής νοείται υποθετικά. Μόνο αν γινόταν δεκτό ως «αποδεικτικό τεκμήριο» ότι οι Δικαστικοί Υπάλληλοι που παρέλαβαν την άνω αίτηση και οι Δικαστικοί Επιμελητές που την επέδωσαν, την ανέγνωσαν, θα ήταν δυνατό να γίνει δεκτό ότι υπέπεσε στην αντίληψή τους και κατανόησαν το καταφρονητικό της τιμής και της υπόληψης της εγκαλούσας περιεχόμενό της. Περαιτέρω αποδείχθηκε ότι κατά την συζήτηση της ως άνω αίτησης ασφαλιστικών μέτρων αυτά που κατέθεσαν οι μάρτυρες τους τα είχε πει η εγκαλουμένη σύζυγος και πίστευαν ότι ήταν αληθή λόγω της συγγενικής τους σχέσης με την εγκαλουμένη σύζυγο και των διαταραγμένων σχέσεων αυτής με τον σύζυγό της. Επίσης δεν αποδείχθηκε ότι η εγκαλουμένη σύζυγος ώθησε τους εν λόγω μάρτυρες με πειθώ και φορτικότητα να καταθέσουν όσα κατέθεσαν ως μάρτυρες κατά την συζήτηση της ανωτέρω αίτησης ασφαλιστικών μέτρων, διότι πληροφορήθηκαν αυτά από την εγκαλούμενη σύζυγό τα οποία εκείνη πίστευε ότι ήταν αληθινά.
